Employment based immigration

Under US Immigration law approx 1,40,000 visas are made available to people who make their Visa application under this category. Those applicants who make their Visa application under this category are eligible to apply for lawful permanent Residents of the USA. The employment based immigration visa also allows the family members of the applicants to move them. Click here to know more.

Under this category the visa applications are divided into five preferences those are:

 

  • Employment First preference: The first category is known as EB1 Visa. In this category people with extraordinary talent in science, arts, business, are included. Researchers, professors, multinational executives and managers are also given a place in this category. The EB1 is sub categorised into EB-1A , EB-1B , EB-1C which includes Workers with extraordinary ability, Outstanding foreign researchers or professors, Managers and executives transferred from multinational corporations respectively.

 

  • Employment Second preference: The second category is known as EB-2 Visa. It is granted to foreign nationals who have advanced degrees or any foreign national with exceptional ability who can contribute to the nation's interest.

Professionals having an advanced degree or a baccalaureate degree and at least five years of progressive experience are eligible for the EB-2 visa. Professionals having an exceptional ability must have some expertise which should be extraordinary. Professionals seeking national interest waiver must show that his degree or ability is so extraordinary that he can contribute culturally or economically in nations interest.

  • Employment Third preference : The third category is known as EB- 3 Visa and it is granted to professionals , skilled workers and unskilled workers.

Professionals are defined as persons whose occupation requires 4 years of college or university degree. Skilled workers are defined as Workers who have two years of work experience. Unskilled workers are defined as those who have less than two years of work experience.

 

  • Employment fourth preference: The fourth category is known as EB-4 Visa. These visas are designed for special immigrants. Most of these are granted to religious workers, Iraqi and Afghani translators, military personnel, workers of international organisations, Iraqis who have assisted USA and Retired NATO employees.
  • Employment Fifth preference: The fifth category is known as EB-5 Visa. These visas are designed for foreign investors. In the EB-5 Visa category the person has to make an investment of $ 900000 or 1.8 million in a US business entity which in turn creates 10 full time jobs. USCIS designates some regional centres which manage investment based immigration projects, the EB-5 investors have the option to invest in these entities also.
