Humanitarian, Refugee - special status and investment based immigration.
Humanitarian based immigration : The USCIS grants humanitarian parole to people who do not have a Visa for entry to the USA. Humanitarian parole is an alternative for a US Visa which a foreign national can use for his entry to the US. The humanitarian parole is granted in case of emergency or on reasons of public interest. Mostly the humanitarian parole is used by those foreign nationals who have to pay visit to their ill family member ,have to attend funerals or have to seek any medical assistance in the USA. The USCIS reviews the application made under this kind of immigration and approves or denies them.
Refugees and special immigration status : A Refugee is a person who has fled his country because of fear of persecution based on religious or political reason. The United Nations High Commissioner for Refugees (UNHCR) as well as the United States Citizen and Immigration Services (USCIS) confers refugee status. The USCIS determines refugee status of a person according to sec 101(a)(42) of the Immigration and Nationality Act (INA).
The essentials to be refugee includes certain points that are –
- The person applying for refugee status should be located outside the USA.
- The Fear of persecution should be one of following things : race, religion, nationality, membership in a particular social group, or political opinion
- The person applying for refugee status should not have already resettled in another country.
- The person applying for refugee status should not be inadmissible to the USA.
Investment-related immigration : The investment related immigration is known as EB-5 Visa. It is the same as the fifth category of Employment based visa application. In the EB-5 Visa category the person has to make an investment of $ 900000 or 1.8 million in a US business entity which in turn creates 10 full time jobs. USCIS designates some regional centres which manage investment based immigration projects, the EB-5 investors have the option to invest in these entities also.
